Sobre dos versiones opuestas de iusnaturalismo: “excluyente” versus “incluyente”

Resumen

Este artículo toma la dicotomía entre positivismo jurídico “excluyente” e “incluyente” y la aplica por analogía a teorías iusnaturalistas. En John Finnis y en Beyleveld y Brownsword tenemos ejemplos de iusnaturalismo “excluyente”. En tales aproximaciones el Derecho es válido solo si sus contenidos satisfacen principios de una teoría normativa monológica. Las teorías discursivas de Alexy y Habermas se consideran como teorías iusnaturalistas “incluyentes” en las que el Derecho positivo es un momento constitutivo en el cual se identifican reglas morales y se especifica su significado. El artículo sostiene que las teorías iusnaturalistas “incluyentes” son más apropiadas para articular una auténtica actitud “republicana”.
