Advertising to Get Sick: Restrictions to the Marketing of Ultra-processed Food to Children in the Colombian Constitution

Resumen

La publicidad de productos alimenticios ultraprocesados, generalmente altos en grasas saturadas, sal y azúcares libres, dirigida a niños y niñas es una práctica común en Colombia y en muchos lugares del mundo. Este artículo analiza la necesidad y legitimidad de las medidas que limitan la publicidad de estos productos en el marco constitucional colombiano. El artículo argumenta que, de acuerdo a la jurisprudencia vigente en materia de tabaco y otros casos relevantes, estas medidas no limitan el principio de libertad de empresa, no son desproporcionadas, ni paternalistas, y no violan la libertad de expresión de las industrias. Al contrario, los principios de prevención y precaución establecen que estas medidas son necesarias para prevenir y precaver los efectos nocivos que la publicidad puede tener sobre la salud de niños y niñas.
