Resumen
En este texto se desarrollan tres críticas a Democracia sin atajos (2020), de Cristina Lafont. En primer lugar, se argumenta que dicha obra formula un ideal de justificación doxástica de las leyes cognitivamente muy exigente para el ciudadano común, y que omite considerar aspectos virtuosos de la deferencia a las autoridades epistémicas y las suspensiones del juicio. En segundo lugar, al pedir que el ciudadano no solo “apoye” esclarecidamente, sino que además se “identifique” con las leyes que lo sujetan, introduce un vector de tensión en la práctica, ya que las motivaciones psicológicas para identificarse pueden diferir –y de hecho difieren– de las motivaciones para apoyar racionalmente una decisión política. Finalmente, se argumenta que la institución de la revisión judicial es incapaz de forjar los incentivos apropiados para lograr el apoyo esclarecido de la mayoría de la población sujeta a las leyes, y que otras instituciones participativas –como las iniciativas ciudadanas de referéndum– resultarían más eficientes en ese cometido.
