Resumen
El artículo analiza la propuesta de Yair Listokin de utilizar el derecho como instrumento de política macroeconómica, evaluándola a partir de la teoría del valor razonable de John R. Commons, figura central del institucionalismo original estadounidense. La propuesta de Listokin surge ante la ineficacia de las políticas fiscales y monetarias tradicionales en contextos de estancamiento secular. Los autores advierten que esta visión puede derivar en un despotismo legal al subordinar el derecho a criterios exclusivamente económicos, especialmente en la ejecución de megaproyectos. Se argumenta que ello erosiona el propósito público y la distribución plural de la soberanía defendida por Commons.
