Resumen
Dada la importancia de las medidas cautelares dentro del proceso arbitral a efectos de garantizar el cumplimiento del laudo, surge la figura del árbitro de emergencia como competente para establecer la medida. Surge sin embargo la problemática de establecer de un lado la naturaleza de sus decisiones y la posibilidad de hacerlas exigibles a través de la ejecución en el arbitraje comercial internacional.
