The Incorporation of Statutory Damages as Criteria of Determination for Damages in Infringements of Copyright in Colombia

Resumen

Con la firma del Tratado de Libre Comercio con los Estados Unidos, Colombia adquirió la obligación de incorporar la figura de daños preestablecidos a las formas de tasación del daño de la Ley 44 de 1993. Dado que es obligación del Gobierno regular esta figura —propia del sistema legal anglosajón—, este artículo pretende dilucidar cómo podría incorporarse a la concepción tradicional del derecho de daños en el país, cumpliendo la finalidad de los derechos de autor.
